As used in this chapter: 

(1) “Counsel for the United States” means—

(A) a United States attorney, an assistant United States attorney designated to act on behalf of the United States attorney, or an attorney with the United States Department of Justice or with a Federal agency who has litigation authority; and

(B) any private attorney authorized by contract made in accordance with section 3718 of title 31 to conduct litigation for collection of debts on behalf of the United States.

 

(2) “Court” means any court created by the Congress of the United States, excluding the United States Tax Court.

 

(3) “Debt” means—

(A) an amount that is owing to the United States on account of a direct loan, or loan insured or guaranteed, by the United States; or

(B) an amount that is owing to the United States on account of a fee, duty, lease, rent, service, sale of real or personal property, overpayment, fine, assessment, penalty, restitution, damages, interest, tax, bail bond forfeiture, reimbursement, recovery of a cost incurred by the United States, or other source of indebtedness to the United States, but that is not owing under the terms of a contract originally entered into by only persons other than the United States;

and includes any amount owing to the United States for the benefit of an Indian tribe or individual Indian, but excludes any amount to which the United States is entitled under section 3011 (a).

 

(4) “Debtor” means a person who is liable for a debt or against whom there is a claim for a debt.

(5) “Disposable earnings” means that part of earnings remaining after all deductions required by law have been withheld.

 

(6) “Earnings” means compensation paid or payable for personal services, whether denominated as wages, salary, commission, bonus, or otherwise, and includes periodic payments pursuant to a pension or retirement program.

 

(7) “Garnishee” means a person (other than the debtor) who has, or is reasonably thought to have, possession, custody, or control of any property in which the debtor has a substantial nonexempt interest, including any obligation due the debtor or to become due the debtor, and against whom a garnishment under section 3104 or 3205 is issued by a court.

 

(8) “Judgment” means a judgment, order, or decree entered in favor of the United States in a court and arising from a civil or criminal proceeding regarding a debt.

 

(9) “Nonexempt disposable earnings” means 25 percent of disposable earnings, subject to section 303 of the Consumer Credit Protection Act.

 

(10) “Person” includes a natural person (including an individual Indian), a corporation, a partnership, an unincorporated association, a trust, or an estate, or any other public or private entity, including a State or local government or an Indian tribe.

 

(11) “Prejudgment remedy” means the remedy of attachment, receivership, garnishment, or sequestration authorized by this chapter to be granted before judgment on the merits of a claim for a debt.

 

(12) “Property” includes any present or future interest, whether legal or equitable, in real, personal (including choses in action), or mixed property, tangible or intangible, vested or contingent, wherever located and however held (including community property and property held in trust (including spendthrift and pension trusts)), but excludes—

(A) property held in trust by the United States for the benefit of an Indian tribe or individual Indian; and

(B) Indian lands subject to restrictions against alienation imposed by the United States.

 

(13) “Security agreement” means an agreement that creates or provides for a lien.

 

(14) “State” means any of the several States, the District of Columbia, the Commonwealth of Puerto Rico, the Commonwealth of the Northern Marianas, or any territory or possession of the United States.

 

(15) “United States” means—

(A) a Federal corporation;

(B) an agency, department, commission, board, or other entity of the United States; or

(C) an instrumentality of the United States.

 

(16) “United States marshal” means a United States marshal, a deputy marshal, or an official of the United States Marshals Service designated under section 564.

The file is only about 5 min long. Below is copied from the transcript:

"The very word "secrecy" is repugnant in a free and open society; and we are as a people inherently and historically opposed to secret societies, to secret oaths and secret proceedings. We decided long ago that the dangers of excessive and unwarranted concealment of pertinent facts far outweighed the dangers which are cited to justify it. Even today, there is little value in opposing the threat of a closed society by imitating its arbitrary restrictions. Even today, there is little value in insuring the survival of our nation if our traditions do not survive with it. And there is very grave danger that an announced need for increased security will be seized upon those anxious to expand its meaning to the very limits of official censorship and concealment. That I do not intend to permit to the extent that it is in my control. And no official of my Administration, whether his rank is high or low, civilian or military, should interpret my words here tonight as an excuse to censor the news, to stifle dissent, to cover up our mistakes or to withhold from the press and the public the facts they deserve to know."

In my efforts to provide you a transcript of the attached file, I have discovered that the above paragraph is word for word the first 1:26.

The next 3 paragraphs and the first sentence of the next paragraph were omitted. I do not know why since I do not know what the editor of the original speech had in his or her mind. The file continues .....

"For we are opposed around the world by a monolithic and ruthless conspiracy that relies on covert means for expanding its sphere of influence--on infiltration instead of invasion, on subversion instead of elections, on intimidation instead of free choice, on guerrillas by night instead of armies by day. End at 2:28 - This is a solid piece in the transcript but ends mid paragraph.

Several more paragraphs of the transcript are skipped and the file continues.......

That is why the Athenian lawmaker Solon decreed it a crime for any citizen to shrink from controversy. And that is why our press was protected by the First (emphasized) Amendment-- the only business in America specifically protected by the Constitution-- not primarily to amuse and entertain, not to emphasize the trivial and sentimental, not to simply "give the public what it wants"--but to inform, to arouse, to reflect, to state our dangers and our opportunities, to indicate our crises and our choices, to lead, mold educate and sometimes even anger public opinion.

This means greater coverage and analysis of international news-- for it is no longer far away and foreign but close at hand and local. It means greater attention to improved understanding of the news as well as improved transmission. And it means, finally, that government at all levels, must meet its obligation to provide you with the fullest possible information outside the narrowest limits of national security...

This part ends at 4:52. mid sentence. It left out "--and we intend to do it." It also skips a paragraph and then the file continues ...

Principle 1 - The only reliable basis for sound government and just human relations is Natural Law.

Natural law is God's law. There are certain laws which govern the entire universe, and just as Thomas Jefferson said in the Declaration of Independence, there are laws which govern in the affairs of men which are "the laws of nature and of nature's God."

Principle 2 - A free people cannot survive under a republican constitution unless they remain virtuous and morally strong.

Principle 3 - The most promising method of securing a virtuous people is to elect virtuous leaders.

Principle 4 - Without religion the government of a free people cannot be maintained.

"Of all the dispositions and habits which lead to political prosperity, religion and morality are indispensable supports.... And let us with caution indulge the supposition that morality can be maintained without religion." - George Washington

Principle 5 - All things were created by God, therefore upon him all mankind are equally dependent, and to him they are equally responsible.

The American Founding Fathers considered the existence of the Creator as the most fundamental premise underlying all self-evident truth. They felt a person who boasted he or she was an atheist had just simply failed to apply his or her divine capacity for reason and observation.

Principle 6 - All mankind were created equal.

The Founders knew that in these three ways, all mankind are theoretically treated as:

1.      Equal before God.

2.      Equal before the law.

3.      Equal in their rights.

Principle 7 - The proper role of government is to protect equal rights, not provide equal things.

The Founders recognized that the people cannot delegate to their government any power except that which they have the lawful right to exercise themselves.

Principle 8 - Mankind are endowed by God with certain unalienable rights.

"Those rights, then, which God and nature have established, and are therefore called natural rights, such as are life and liberty, need not the aid of human laws to be more effectually invested in every man than they are; neither do they receive any additional strength when declared by the municipal [or state] laws to be inviolable. Principle 9 - To protect human rights, God has revealed a code of divine law.

"The doctrines thus delivered we call the revealed or divine law, and they are to be found only in the Holy Scriptures. Principle 10- The God-given right to govern is vested in the sovereign authority of the whole people.

Principle 11 - The majority of the people may alter or abolish a government which has become tyrannical.

Principle 12 - The United States of America shall be a republic.

"I pledge allegiance to the flag of the United States of America
and to the republic for which it stands...."

Principle 13 - A Constitution should protect the people from the frailties of their rulers.

"If angels were to govern men, neither external nor internal controls on government would be necessary.... [But lacking these] you must first enable the government to control the governed; and in the next place oblige it to control itself." - James Madison

Principle 14 - Life and liberty are secure only so long as the rights of property are secure.

John Locke reasoned that God gave the earth and everything in it to the whole human family as a gift. Therefore the land, the sea, the acorns in the forest, the deer feeding in the meadow belong to everyone "in common." However, the moment someone takes the trouble to change something from its original state of nature, that person has added his ingenuity or labor to make that change. Herein lies the secret to the origin of "property rights."

Principle 15 - The highest level of prosperity occurs when there is a free-market economy and a minimum of government regulations.

Prosperity depends upon a climate of wholesome stimulation with four basic freedoms in operation:

1.      The Freedom to try.

2.      The Freedom to buy.

3.      The Freedom to sell.

4.      The Freedom to fail.

Principle 16 - The government should be separated into three branches.

"I call you to witness that I was the first member of the Congress who ventured to come out in public, as I did in January 1776, in my Thoughts on Government ... in favor of a government with three branches and an independent judiciary. This pamphlet, you know, was very unpopular. No man appeared in public to support it but yourself." - John Adams

Principle 17 - A system of checks and balances should be adopted to prevent the abuse of power by the different branches of government.

"It will not be denied that power is of an encroaching nature and that it ought to be effectually restrained from passing the limits assigned to it." - James Madison

Principle 18 - The unalienable rights of the people are most likely to be preserved if the principles of government are set forth in a written Constitution.

The structure of the American system is set forth in the Constitution of the United States and the only weaknesses which have appeared are those which were allowed to creep in despite the Constitution.

Principle 19 - Only limited and carefully defined powers should be delegated to government, all others being retained by the people.

The Tenth Amendment is the most widely violated provision of the bill of rights. If it had been respected and enforced America would be an amazingly different country than it is today. This amendment provides:

"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."

Principle 20 - Efficiency and dispatch require that the government operate according to the will of the majority, but constitutional provisions must be made to protect the rights of the minority.

"Every man, by consenting with others to make one body politic under one government, puts himself under an obligation to every one of that society to submit to the determination of the majority, and to be concluded [bound] by it." - John Locke

Principle 21 - Strong local self-government is the keystone to preserving human freedom.

"The way to have good and safe government is not to trust it all to one, but to divide it among the many, distributing to every one exactly the functions he is competent [to perform best]. - Thomas Jefferson

Principle 22 - A free people should be governed by law and not by the whims of men.

"The end of law is not to abolish or restrain, but to preserve and enlarge freedom. For in all the states of created beings, capable of laws, where there is no law there is no freedom. For liberty is to be free from restraint and violence of others, which cannot be where there is no law." - John Locke

Principle 23 - A free society cannot survive as a republic without a broad program of general education.

"They made an early provision by law that every town consisting of so many families should be always furnished with a grammar school. They made it a crime for such a town to be destitute of a grammar schoolmaster for a few months, and subjected it to a heavy penalty. So that the education of all ranks of people was made the care and expense of the public, in a manner that I believe has been unknown to any other people, ancient or modern. The consequences of these establishments we see and feel every day [written in 1765]. A native of America who cannot read and write is as rare ... as a comet or an earthquake." John Adams

Principle 24 - A free people will not survive unless they stay strong.

"To be prepared for war is one of the most effectual means of preserving peace." - George Washington

Principle 25 - "Peace, commerce, and honest friendship with all nations -- entangling alliances with none."- Thomas Jefferson, given in his first inaugural address.

Principle 26 - The core unit which determines the strength of any society is the family; therefore the government should foster and protect its integrity.

"There is certainly no country in the world where the tie of marriage is more respected than in America, or where conjugal happiness is more highly or worthily appreciated." Alexis de Tocqueville

Principle 27 - The burden of debt is as destructive to human freedom as subjugation by conquest.

"We are bound to defray expenses [of the war] within our own time, and are unauthorized to burden posterity with them.... We shall all consider ourselves morally bound to pay them ourselves and consequently within the life [expectancy] of the majority." - Thomas Jefferson 

Principle 28 - The United States has a manifest destiny to eventually become a glorious example of God's law under a restored Constitution that will inspire the entire human race.

The Founders sensed from the very beginning that they were on a divine mission. Their great disappointment was that it didn't all come to pass in their day, but they knew that someday it would. John Adams wrote:

"I always consider the settlement of America with reverence and wonder, as the opening of a grand scene and design in Providence for the illumination of the ignorant, and the emancipation of the slavish part of mankind all over the earth."

I hope you find the time to read this with an open mind.  It's interesting.  Please read it with the open mind rather than immediately breaking it down into left or right, but rather look at it from the neutral viewpoint of right or wrong.  It's like the line below says, "what if he is right?"

David Kaiser is a respected historian whose published works have covered a broad range of  topics, from European Warfare to American League Baseball.  Born in 1947,  the son of a diplomat, Kaiser spent his childhood in three capital cities:   Washington D.C., Albany, New York, and Dakar, Senegal..  He attended Harvard University,  graduating there in 1969 with a B.A. In history.  He then spent several years more at Harvard, gaining a PhD in history, which he obtained in 1976..  He served in the Army Reserve from 1970 to 1976.

He is a professor in the Strategy and Policy Department of the United States Naval War College. He has previously taught at Carnegie Mellon, Williams College and Harvard University.  Kaiser's latest book, The Road to Dallas, about the Kennedy assassination, was just published by Harvard  University Press.

History Unfolding

I am a student of history.  Professionally, I have written15 books on history that have been  published in six languages, and I have studied history all my life.  I have come to think there is something monumentally large afoot, and I do not believe it is simply a banking crisis, or a mortgage crisis, or a credit crisis.  Yes, these exist, but they are merely single facets on a very large gemstone that is only now coming into a sharper focus..

Something of historic proportions is happening.  I can sense it because I know how it feels, smells, what it looks like, and how people react to it.  Yes, a  perfect storm may be brewing, but there is something happening within our country that has been evolving for about ten to fifteen years.  The pace has dramatically quickened in the past two.

We demand and then codify into law the requirement that our banks make massive loans to  people we know they can never pay back?  Why?

We learned just days ago that the Federal Reserve, which has little or no real oversight by anyone, has "loaned" two trillion dollars (that is $2,000,000,000,000) over the past few months, but will not tell us to whom or why or disclose the terms.  That is our money.  Yours and mine. And that is three times the $700 billion we all argued about so strenuously just this past September.  Who has this money?  Why do they have it?  Why are the terms unavailable to us? Who asked for it?  Who authorized it?  I thought this was a government of "we the people," who loaned our powers to our elected leaders.  Apparently not.

We have spent two or more decades intentionally de-industrializing our economy...  Why?

We have intentionally dumbed down our schools, ignored our history, and no longer teach our founding documents, why we are exceptional, and why we are worth preserving.  Students by and large cannot write, think critically, read, or articulate.  Parents are not revolting, teachers are not picketing, school boards continue to back mediocrity.  Why?

We have now established the precedent of protesting every close election (violently in California over a proposition that is so controversial that it simply wants marriage to remain defined as between one man and one woman.  Did you ever think such a thing possible just a decade ago?) We have corrupted our  sacred political process by allowing unelected judges to write laws that  radically change our way of life, and then mainstream Marxist groups like ACORN and others to turn our voting system into a banana republic.  To what purpose?

Now our mortgage industry is collapsing, housing prices are in free fall, major industries are failing, our banking system is on the verge of collapse, social security is nearly bankrupt, as is Medicare and our  entire government.  Our education system is worse than a joke (I teach college and I know precisely what I am talking about) - the list is staggering in its length, breadth, and depth..  It is potentially 1929 x ten...And we are at war with an enemy we cannot even name for fear of offending people of the same religion, who, in turn, cannot wait to slit the throats of your children if they have the opportunity to do so.

And finally, we  have elected a man that no one really knows anything about, who has never run so much as a Dairy Queen, let alone a town as big as Wasilla, Alaska..  All of his associations and alliances are with real radicals in their chosen fields of employment, and everything we learn about him, drip by drip, is unsettling if not downright scary!  (Surely you have heard him speak about his idea to create and fund a mandatory civilian defense force stronger than our military for use inside our borders?  No?  Oh, of course.  The media would never play that for you over and over and then demand he answer it.  Sarah Palin's pregnant daughter and $150,000 wardrobe are more important.)


Mr. Obama's winning platform can be boiled down to one word:  Change.  Why?

I have never been so afraid for my country and for my children as I am now.

This man campaigned on bringing people together, something he has never, ever done in his professional life.  In my assessment, Obama will divide us along philosophical lines, push us apart, and then try to realign the pieces into a new and different power structure.  Change is indeed coming.  And when it comes, you will never see the same nation again.

And that is only the beginning..

As a serious student of history, I thought I would never come to experience what the ordinary, moral German must have felt in the mid-1930s In those times, the "savior" was a former smooth-talking rabble-rouser from  the streets, about whom the average German knew next to nothing. What they should have known was that he was associated with groups that shouted,  shoved, and pushed around people with whom they disagreed; he edged his way onto the political stage through great oratory.  Conservative "losers" read it right now.

And there were  the promises.  Economic times were tough, people were losing jobs, and he was a great speaker.  And he smiled and frowned and waved a lot.  And  people, even newspapers, were afraid to speak out for fear that his "brown shirts" would bully and beat them into submission.  Which they did -  regularly.  And then, he was duly elected to office, while a full-throttled economic crisis bloomed at hand - the Great Depression.  Slowly, but surely he seized the controls of government power, person by person, department by department, bureaucracy by bureaucracy.  The children of German citizens were at first, encouraged to join a Youth Movement in his name where they were taught exactly what to think.  Later, they were required to do so,  No Jews of course!

How did he get people on his side?  He did it by promising jobs to the jobless, money to the money-less, and rewards for the military-industrial complex.  He did it by indoctrinating the children, advocating gun control, health care for all, better wages, better jobs, and promising to re-instill pride once  again in the country, across Europe , and across the world.  He did it with a compliant media - did you know that?  And he did this all in the name of justice and ........  change.  And the people surely got what they voted for. 

If you think I am exaggerating, look it up.  It's all there in the history books.

So read your history books.  Many people of conscience objected in 1933 and were shouted  down, called names, laughed at, and ridiculed.  When Winston Churchill pointed out the obvious in the late 1930s while seated in the House of Lords in England (he was not yet Prime Minister), he was booed into his seat and called a crazy troublemaker.  He was right, though.  And the world came to regret that he was not listened to.

Do not forget that Germany was the most educated, the most cultured country in Europe.  It was full of music, art, museums, hospitals, laboratories, and universities.  And yet, in less than six years (a shorter time span than just two terms of the U. S. presidency) it was rounding up its own citizens, killing others, abrogating its laws, turning children against parents, and neighbors against neighbors..   All with the best of intentions, of course..  The road to Hell is paved with them.

As a practical thinker, one not overly prone to emotional decisions, I have a choice:  I can either believe what the objective pieces of evidence tell me (even if they make me cringe with disgust); I can believe what history is shouting to me from across the chasm of seven decades; or I can hope I am wrong by closing my eyes, having another latte, and ignoring what is transpiring  around me..

I choose to believe the evidence.  No doubt some people will scoff at me, others laugh, or think I am foolish, naive, or both.  To some degree, perhaps I am.  But I have never been afraid to look people in the eye and tell them exactly what I believe-and why I believe  it.

I pray I am  wrong.  I do not think I am.  Perhaps the only hope is our vote in the next elections.

PS:  In addition to the foregoing consider this!  If, by mid-October, it appears that Obama is going to win a second term, Israel must quickly strike Iran, because after the election Obama will undermine any efforts by Israel (and Israel knows this) and before the election he cannot afford to show his true colors or he will lose the election.  Israel knows that Obama is a Muslim at heart and will do anything he can politically afford to do to elevate the Muslim cause and will be more aggressive to do so in a second term.

Americans everywhere;

    Ever since history began to be recorded, we can read of the struggle of man's desire to be free, to live his life as he wishes to pursue his own happiness, free from government control of his life, free from others who think they know best about how he should live. That struggle can be properly spoken of as war. A war between men desiring to be free and men who want to force them into bondage. A war between freedom and slavery, if you will. That war has raged from Cain killing Abel to the present day. It will never end. Why? Because there will always be men trying to bend others to their will, to place them in slavery for their own gain. The American Revolution, the American Civil War, World War I, World War II, and others are tragic examples of men willing to die to remain free from those who would make them slaves. As was true in the wars mentioned, as in all wars, battles are won and battles are lost.

    The Health Care Bill was a battle in which the forces of freedom just lost to the forces of slavery. We must keep in mind, this is a war and battles are won and lost. This is not the end. There will be many more battles, and we must continue the fight. The Health Care Bill can still be overturned but it will not be easy. In order to do it, we must remove Barack Obama from our White House and we must change the Senate so that Harry Reid will no longer be in charge of what comes to the floor for consideration. Before a new president can repeal Obamacare he has to receive a bill to sign. If we leave Obama in office and a bill comes to him, he will veto it. If Mitt Romney is president and a bill comes to him, I believe he will sign it. This will not be easy but it can be done. Do not lose hope. We must not lose faith in ourselves. I believe Obama and his administration full of Socialist Czars are losing ground in their bid to be re-elected. I believe the American people are beginning to understand Obama's intentions are to Socialize this country and make us slaves to his government. This message must be spread across the nation. Everyone must vote. If you like Obama and his Czars and his Socialist policies then he is your man. If you do not like what is happening then you must vote for Romney, even if he was not your choice for the Republican nomination. This is critical. I believe the votes are there to remove Obama. We just need everyone to vote. Americans must be educated about the destruction that this country is facing. I still have faith that the majority of Americans are intelligent enough to realize the mistake which was made in electing this man and remove him from power. If I am right, freedom will prevail.

   The war has reached epic proportions in the United States with our current president, Barack Obama, now leading the Socialist Army to enslave you and me to the Federal government. Socialism makes men slaves to government. Make no mistake about it, Barack Obama and his socialist followers, allies and backers fully intend, and WILL turn the United States of America into the Socialist States of America unless we can stop it in November. President Obama, Congress and the Supreme Court have spoken. It is now our turn to speak and act. The United States Constitution will become nothing more than a tiny heap of shredded paper if we fail to do so.

   As I have quoted before, "if we must die, let us stand tall and die on our feet fighting, and not on our knees in subjugation." We must rededicate ourselves to the proposition that this is a country of Individual Freedom and Free Enterprise and be devoted to our Representative Constitutional Republic, and strengthen our resolve to keep it by winning this battle for the hearts and minds of men and women all across this nation against socialism. We MUST hang on to our way of life and our Constitutional Republic with every fabric of our being. We MUST return to the limited powers of government according to the United States Constitution.
